No ‘Second Placer Rule’ in Local Polls: SC Issues Final Ruling on Mangudadatu Case

The Supreme Court (SC) En Banc has denied with finality the motion for reconsideration filed by Sultan Kudarat Governor Datu Pax Ali S. Mangudadatu, cementing the nullification of his 2022 election victory.

During its session, the High Tribunal affirmed its previous landmark liability ruling, upholding the Commission on Elections (COMELEC) decision to cancel Mangudadatu’s Certificate of Candidacy (COC). The COMELEC originally found that Mangudadatu committed material false misrepresentation regarding his residency requirements. He remained the active mayor of Datu Abdullah Sangki, Maguindanao, while simultaneously running for the Sultan Kudarat governorship.

The End of the 'Second Placer Rule'

In a historic doctrine shift, the SC used this case to permanently abandon the long-standing "second placer rule" for local elective positions. Under past election practices, a runner-up candidate could sometimes be declared the winner if the top vote-getter was disqualified. The High Court clarified the following legal principles:

No law authorizes a second-place finisher to assume office. Forcing an unelected runner-up onto the electorate directly undermines the constitutional right to suffrage. The second placer is simply a candidate who lost and did not secure the people's choice. This rule applies directly to all pending local election cases.

Vice Governor to Assume Office

The SC declared that the cancellation of Mangudadatu's COC creates a permanent vacancy in the gubernatorial seat. Rather than handing the position to second-place finisher and 2022 election rival Sharifa Akeel Mangudadatu, the vacancy must be filled through local succession.

Per Section 44 of the Local Government Code, the duly elected Vice Governor of Sultan Kudarat will succeed to the gubernatorial post to serve the remainder of the term. The high court explicitly directed Mangudadatu to surrender the Office of the Governor.

Provincial Office Maintains Stance

Despite the definitive ruling from the highest court of the land, the Office of the Governor maintains that Mangudadatu will finish his mandate. Kaharudin Dalaten, Chief of Staff of the Office of the Governor of Sultan Kudarat, publicly countered the immediate execution of the order.

"SI GOV. DATU PAX ALI MANGUDADATU pa din ang ating GOBERNADOR hanggang 2028,"(Our Governor Datu Pax Ali Mangudadatu is still our governor until 2028) Dalaten stated, insisting their camp expects the governor to retain his position.

The definitive resolution concludes a multi-year legal battle over the province's top seat, setting a major legal precedent that reshapes Philippine election jurisprudence regarding local governance succession.
