DOLE Issues Pay Rules for August 2026 Holidays

The Department of Labor and Employment (DOLE) has reminded private sector employers to strictly observe proper wage compliance for the two upcoming holidays this month: Ninoy Aquino Day on August 21 and National Heroes Day on August 31.

Under Labor Advisory No. 13, Series of 2026, signed by Labor Secretary Francis Tolentino, specific pay structures will apply depending on the holiday classification and whether an employee renders service.

August 21: Ninoy Aquino Day (Special Non-Working Day)

As a special non-working day under Proclamation No. 1006, the "no work, no pay" rule applies unless otherwise stated by company policy or a collective bargaining agreement.

For work rendered: An additional 30% of the basic wage is added for the first eight hours (130% total), with an extra 30% hourly rate for overtime.
Rest day work: Employees working on their scheduled rest day receive 150% for the first eight hours.

August 31: National Heroes Day (Regular Holiday)

Classified as a regular holiday, employees receive 100% pay even if unworked, provided they worked or were on paid leave the previous day.

For work rendered: Employees receive 200% for the first eight hours, plus an additional 30% hourly rate for overtime work.
Rest day work: Working on a regular holiday that falls on a rest day entitles the worker to 260% of their basic wage.

DOLE urges employers to ensure accurate wage computation and compliance to protect workers' welfare.
